General Terms and Conditions of Sale

Article 1 – Definitions

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") are offered by SAS LINKUMA, a company registered with the Annecy Trade and Companies Register under SIRET number 92111884000039, with its registered office at 20 chemin des poses 74330 Poisy.

Hereinafter, the following terms will be used:

« Site »: the website https://www.linkuma.comm and all its pages.
« Services »: all services (offerings) that can be purchased or subscribed to on the Site.
« Seller »: LINKUMA, a legal entity, offering its Services on the Site.
« Client »: the internet user, whether an individual or a professional, purchasing Service(s) on the Site.
« Partner »: the internet user, whether an individual or a professional, making their website(s) available to promote Client websites.
« Writer »: the internet user, whether an individual or a professional, offering their Services for writing Client content.
« Consumer », in accordance with the definition in the preliminary article of the Consumer Code: « any natural person acting for purposes that are outside their trade, business, craft or profession ».
Internet users visiting the Site and interested in the Products and Services offered by the Seller are invited to carefully read these GTC, print them, and/or save them on a durable medium before placing an order on the Site.
The Client acknowledges having read and fully accepted these GTC without reservation.

Article 2 – Application of the GTC and Purpose of the Site

The Seller reserves the right to modify the GTC at any time by publishing a new version on the Site. The GTC applicable to the Client are those in force on the day of their order on the Site.

This Site offers link building services (backlink creation).
The Site is freely accessible to all Clients. Purchasing a Service implies the Client's full acceptance of these GTC, thereby acknowledging that they have read them completely. This acceptance may, for example, involve the Client checking the box corresponding to the acceptance phrase for these GTC, such as « I acknowledge that I have read and accepted all the general terms and conditions of the Site » when purchasing a Service. Checking this box will be considered to have the same value as a handwritten signature from the Client.

Acceptance of these GTC implies that Clients possess the necessary legal capacity to do so. If the Client is a minor or lacks this legal capacity, they declare that they have the authorization of a guardian, curator, or their legal representative.

The Client acknowledges the evidentiary value of the Seller's automatic recording systems and, unless they can provide proof to the contrary, they waive the right to dispute them in the event of a dispute.

The Seller reserves the right to refuse the publication of links if the Client's site deals with an illegal subject (e.g., casino) or a contentious one (e.g., CBD).

Article 3 – Prices and Products

Prices for Publications on the Platform start from €7, €10, €30, and up.
Prices are expressed in euros, excluding tax.

The price including tax (TTC) will be displayed on the Summary page during order finalization.
The price including tax (TTC) includes processing fees.

Article 4 – Homepage Link Offer (HP) – Duration and Renewal

The Homepage Link Offer (HP) is available as a subscription with an initial duration of twelve or twenty-four months.
At the end of this initial period, the subscription is tacitly renewed for the same duration, unless terminated under the conditions specified below.

The Client may request the cancellation of automatic renewal within two months prior to the subscription's expiry date. A notification email is sent to the Client two months before the subscription's expiry date, informing them of the upcoming automatic renewal. The Client will be redirected to a link allowing them to deactivate automatic renewal.

Any request made after this deadline cannot be taken into account, and the subscription will then be automatically renewed for a new period, with no possibility of cancellation before the next contractual due date.

Article 5 – Project saturation / publication capacity

Each project may only be published once per site. In the event of a promotion or saturation activity, if your project reaches 100% capacity on all available sites, any new publications awaiting publication will be automatically blocked. You will then be invited to create a new project to continue your publications. Any costs associated with creating this additional project will be your responsibility.

Article 6: Registration of Foreign Companies

The business account for a foreign client will be validated once the company has provided official proof of its registered address.

 Article 7 – Payment Conditions

Payments can be made online by credit card through Stripe.
Bank transfers are also accepted. Details for bank transfers are provided when you finalize your order.

Article 8 – Website Responsibility

The website cannot be held responsible for any server or network malfunction.
Similarly, the website is not liable in cases of force majeure or unforeseen and unavoidable actions by a third party.
The website commits to using all necessary measures to ensure data security and confidentiality. However, it does not provide a complete security guarantee. 

Article 9 – Personal Data

Users must provide personal information to register on the website.
The user's email address may be used by the website for various communications and account management.
The website guarantees the user's privacy, in accordance with Law No. 78-17 of January 6, 1978, concerning data processing, files, and freedoms.
Under Articles 39 and 40 of the Law of January 6, 1978, users have the right to access, rectify, delete, and object to the processing of their personal data.

Article 10 – Purchase Conditions on the Linkuma Platform

Quotes are valid for 15 days. After this period, if the quote is not signed, it becomes void.

Purchases made by the user on the Linkuma platform are valid for two (2) years from the date of purchase.

Purchases made by the user on the Linkuma platform, including credits or units used to order services, remain usable for a period of two (2) years from their purchase date.

Linkuma may inform the user, by any appropriate means, of the approaching expiration date of their credits to allow them to use them within the given timeframe.

The user acknowledges that purchases made on the platform, including credits, are non-refundable for any reason, even if their validity period has not yet expired.

Bonus credits (credited after using a bonus code when purchasing credits) are valid only for Citation, Starter, Linkuma, and Boost. They cannot be used for deals, the Marketplace, or other offers.

Article 11 – Applicable Law and Competent Jurisdiction

This contract is governed by French law. In the event of a dispute between the User and the website that cannot be resolved amicably, the courts of Saint-Étienne have jurisdiction to settle the dispute.

Article 12 - “Indexed or Replaced” Offer

The “Indexed or Replaced” offer involves:
Checking the website's presence on Google's various data centers using the 'site:' command.
If the site is not present (via the 'site:' command) within 21 days, Linkuma will publish a different article on another website from its network, using the same anchor text and target link. The first, unindexed link will also be retained.

This offer is limited to one (1) replacement. If the content is not indexed a second time, support will be available to the client/platform user to find a solution.
The indexing guarantee means the article will be indexed at least once, but it cannot guarantee that the link will remain indexed indefinitely.

Linkuma does not guarantee the indexing of articles provided directly by the client. Their publication does not imply any obligation of result regarding their indexing.

Poisy, France
