Article 1 – Definitions

These General Terms and Conditions of Sale (hereinafter the “GTCS”) are offered by SAS LINKUMA, a company registered with the RCS of Saint-Etienne under the SIRET number 921118840, whose registered office is located at 180 lotissement du stade, 42140 GRAMMOND.

On désignera par la suite :

“Site”: the https://www.linkuma.com website and all its pages.
“Services”: all services that can be purchased or subscribed to on the Site.
“Vendor”: LINKUMA, a legal entity, offering its Services on the Site.
“Customer”: the Internet user, individual or professional, purchasing Service(s) on the Site.
“Partner”: the Internet user, individual or professional, providing his/her website(s) to promote the Customer’s website(s).
“Writer”: the Internet user, individual or professional, offering his or her Services to write Customer content.
“Consumer”, as defined in the preliminary article of the French Consumer Code: “any natural person who acts for purposes that do not fall within the scope of his or her commercial, industrial, artisanal or liberal activity”.
Internet users visiting the Site and interested in the Products and Services offered by the Vendor are invited to read these GTC carefully, to print them out and/or save them on a durable medium, before placing an order on the Site.
The Customer acknowledges having read and understood the GTCS and accepts them in full and without reservation.

Article 2 – Application of the GCS and purpose of the Site

The Vendor reserves the right to modify the GCS at any time by publishing a new version on the Site. The GCS applicable to the Customer are those in force on the day of the Customer’s order on the Site.

This Site offers the sale of netlinking (creation of backlinks).
The Site is freely accessible to all Customers. The acquisition of a Service implies the Customer’s acceptance of the entirety of these General Terms and Conditions of Sale, and the Customer acknowledges that he/she is fully aware of them. This acceptance may consist, for example, in the Customer checking the box corresponding to the sentence accepting the present General Terms and Conditions of Sale, for example “I acknowledge having read and accepted all the general terms and conditions of the Site” when purchasing a Service. Ticking this box will be deemed to have the same value as a handwritten signature by the Customer.

Acceptance of these GTC implies that the Customer has the legal capacity to do so. If the Customer is a minor or lacks legal capacity, he/she declares that he/she has the authorization of a tutor, curator or legal representative.

The Customer acknowledges the evidential value of the Vendor’s automatic recording systems and, unless he/she provides proof to the contrary, waives the right to contest them in the event of a dispute.

The seller reserves the right to refuse the publication of links if the customer’s site deals with an illegal (e.g. casino) or contentious (e.g. cbd) subject.

Article 3 – Prices and Products

The prices of Publications on the Platform are €7; €10; €30, and more.
Prices are expressed in euros excluding VAT.

The price including VAT will be displayed when the order is finalized on the Summary page.
The price including VAT includes processing costs.

Article 4 – Terms of payment

Payment is made online by credit card using the Stripe service.
Payment is also possible by bank transfer. The data is transmitted when the order is finalized.

Article 5 – Site liability

The site cannot be held liable for any malfunction of the server or network.
Similarly, the site may not be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
The site undertakes to use all necessary means to guarantee the security and confidentiality of data. However, it does not guarantee total security.

Article 6 – Personal data

The User must provide personal information in order to register on the site.
The User’s electronic address (e-mail) may be used by the site for the communication of various information and account management.
The site guarantees respect for the user’s privacy, in accordance with French law no. 78-17 of January 6, 1978 on data processing, data files and individual liberties.
In accordance with articles 39 and 40 of the law dated January 6, 1978, the User has the right to access, rectify, delete and oppose his or her personal data.

Article 7 – Applicable law and jurisdiction

This contract is governed by French law. In the event of a dispute not amicably resolved between the User and the site, the courts of Saint-Etienne shall have jurisdiction to settle the dispute.

Article 8 – Validité des crédits

Les crédits achetés sur le site LINKUMA.COM sont valides pendant 2 (deux) ans.

“Indexed or replaced” offer

The indexed or replaced offer consists of :
Checking the site’s presence on Google’s various datacenters using the site command:
If not present – via site order: – within 21 days. Linkuma will publish a different article with the same anchor and target link on another website in its network. The first link remains unindexed.

This offer is limited to one (1) replacement. In the event of non-indexing a second time, support will be available to the customer/platform user to find a solution.
The indexing guarantee implies that the article will be indexed at least once, but cannot guarantee that the link will remain indexed over time.
